Waiver of Requirements of 24 CFR 203.37a(b)(2)Beginning February 1, 2010 and for a one year period, FHA will eliminate the 90-day resale restriction, thus permitting buyers to use FHA-insured financing to purchase other bank-owned properties or properties sold through private sales for resale within 90 days of the seller’s acquisition. FHA has determined that temporarily eliminating this restriction is necessary to provide a greater opportunity of disposing its REO properties in a way that maximizes return to the FHA mortgage insurance fund. This will encourage private investors to purchase REO properties for the purpose of rehabilization and resale for a profit.  

The Worker, Homeownership, and Business Assistance Act of 2009 has extended the tax credit of up to $8,000 for qualified first-time home buyers purchasing a principal residence. It also authorized a tax credit of up to $6,500 for qualified repeat home buyers. The tax credit now applies to sales occurring on or after January 1, 2009 and on or before April 30, 2010. However, in cases where a binding sales contract is signed by April 30, 2010, a home purchase completed by June 30, 2010 will qualify. The law defines a tax credit qualified move-up home buyer (“long-time resident”) as a person who has owned and resided in the same home for at least five consecutive years of the eight years prior to the purchase date.
